1. Introduction and Acceptance

This Privacy Policy (“Policy”) describes how Cowen Construction Company (“Cowen,” “we,” “us,” or “our”) collects, uses, discloses, and protects information when you visit cowenconstruction.com (the “Site”).
By accessing or using the Site, you acknowledge that you have read this Policy. Where applicable law requires affirmative consent before certain data collection begins — including before non-essential cookies, analytics, or advertising technologies load — we obtain that consent through the cookie consent tool described in Section 4, not merely through continued browsing.
This Policy applies to all visitors to the Site, including prospective clients, subcontractors/trade partners, job applicants, and any other users.

2. Information We Collect

2.1 Trade Partner Application

When you submit our Trade Partner Application, we collect: company name; primary and secondary trade; company address (street, city, state, zip); primary contact name; office phone; fax; email; cell phone; SIC/NAICS code; contractor’s license number; DUNS number; and Federal Tax ID number. This information is used to evaluate and maintain a network of qualified subcontractors and vendors for bidding on Cowen projects, and is treated as confidential business information.

2.2 Bid Invitations

Prospective clients may submit a request through our “Send Bid Invite” page to begin a conversation about a construction project. This form collects contact and project information you choose to provide. [Exact field list to be confirmed and inserted once verified directly against the live form.]

2.3 Careers (“Apply Now”)

Our “Apply Now” page directs job applicants to Hireology, a third-party recruiting and applicant-tracking platform, where applications, resumes, and related information are submitted and processed. Cowen does not collect or store this information directly through the Site — it is collected and held by Hireology under Hireology’s own privacy policy, and shared with Cowen for hiring purposes. Please review Hireology’s privacy policy before applying.

2.4 Information Collected Automatically

When you visit the Site, we automatically collect: IP address and approximate location, browser type and version, device type and operating system, screen resolution, referring/exit pages, pages viewed, links clicked, and date/time of visit. This is collected via the cookies and technologies described in Section 4.

2.5 Third-Party and Embedded Content

YouTube. The Site embeds numerous project and company videos via YouTube, including in the “Featured Projects” section and a dedicated “Our History” feature. Where properly configured, embedded videos display as a thumbnail with a prompt to accept Marketing cookies, and the video player and any associated data collection do not load until you click to accept. (See verification note at the top of this document — this needs to be confirmed for every embedded video on the Site, not assumed from a single example.)

Instagram. The Site displays a feed of our recent Instagram posts directly on the homepage. Depending on configuration, this feature may involve a request to Instagram/Meta’s servers to retrieve post content. (See verification note above.)

Social media links. The Site links to our Facebook, Instagram, and LinkedIn profiles. These are outbound links only, governed by each platform’s own privacy policy.

Employee Store. A link in the Site footer directs current employees to a third-party merchandise store (via Logoshop) for company apparel; purchases there are governed by that provider’s own privacy and payment terms, not this Policy.
When you interact with any embedded or linked third-party content, that party may independently collect information under its own privacy policy. We do not control, and are not responsible for, those third parties’ data practices.

3. How We Use Information

We use the information described above to:

• Evaluate and manage trade partner/subcontractor relationships and bid opportunities
• Respond to prospective client bid invitations and project inquiries
• Operate, maintain, secure, and improve the Site
• Understand how visitors use the Site (aggregate analytics) to improve content and navigation
• Measure the effectiveness of our marketing and community outreach efforts
• Comply with legal, licensing, and contractual obligations
• Detect, investigate, and prevent fraudulent or unauthorized activity

4. Cookies, Tracking Technologies, and Analytics

This section discloses the tracking technologies used on the Site, consistent with the California Invasion of Privacy Act (“CIPA,” Cal. Penal Code §§ 631, 632, 638.50–638.51) and comparable state and federal privacy laws.

4.1 Categories of Cookies

• Essential — Necessary for the Site to function, including remembering your cookie consent choices. Cannot be disabled.
  
• Statistics — Pseudonymized usage data (Google Analytics) to help us understand and improve the Site. Off by default; requires consent.
  
• Marketing — Supports embedded video content and advertising measurement (YouTube, Google Ads) and, if confirmed client-side, the Instagram feed widget. Off by default; requires consent.

4.2 Cookie Details

Statistics — Google Analytics (GA4)
Loads only after consent to the Statistics category.

Google Analytics acts as our service provider solely to help us understand aggregate Site usage. It is not authorized to use this data for its own independent purposes, and no Cowen employee, agent, or contractor reviews individual visitor sessions in real time. You may opt out via the Google Analytics Opt-out Browser Add-on (tools.google.com/dlpage/gaoptout), our cookie consent tool (Section 4.3), or your browser settings.
Marketing — YouTube / Google Advertising Infrastructure / Instagram
Embedded YouTube videos and related Google advertising-measurement calls are intended to load only after you accept Marketing cookies. [PENDING VERIFICATION — see notice at top of document.] If confirmed to load client-side, the Instagram feed widget will also be listed in this category.

4.3 Cookie Consent Management

Cowen uses WPConsent to give visitors notice of, and control over, non-essential cookies. You can accept or reject the Statistics and Marketing categories (Essential cookies cannot be disabled) and change your preferences at any time via the cookie settings tool on the Site.

4.4 Browser and Device Controls

Most browsers let you block or delete cookies through browser settings; disabling cookies may affect Site functionality. The Site does not respond to “Do Not Track” signals but will honor recognized opt-out preference signals (e.g., California’s Global Privacy Control) where required by law.

5. Disclosure Regarding Electronic

Communications and Consent to Monitoring
To directly address CIPA and comparable electronic-surveillance statutes:

• This Policy provides advance notice that Site interactions — page views, clicks, form submissions, and related metadata — may be recorded and transmitted to Cowen and its service providers for the purposes described herein, subject to the consent requirements in Section 4.
• Any third party processing Site data does so as our service provider, under terms restricting use of that data to providing services to Cowen — not as an independent party intercepting communications for unrelated purposes.
• Statistics and Marketing category technologies are not activated until you provide affirmative consent through the tool described in Section 4.3.
• If you do not consent, reject non-essential cookies through the consent tool and/or use browser-level controls.

6. How We Share Information

We do not sell personal information. We may share information with:

• Service providers who perform services on our behalf (website hosting, analytics, email), under obligations to use it only for the purposes we specify
  
• D2 Branding, our website design and maintenance vendor, which may access website analytics and back-end systems solely to provide maintenance and support, and does not use that access for independent marketing purposes
  
• Hireology, for processing job applications submitted through our careers page
• Legal and regulatory authorities, where required by subpoena, court order, licensing obligations, or other legal process, or to protect the rights, safety, or property of Cowen or others
• A successor entity, in connection with a merger, acquisition, or sale of assets

7. Your Privacy Choices and Rights

Cookie preferences: Manage anytime via the consent tool on the Site or your browser settings (Section 4.4).
California residents (CCPA/CPRA): You may request disclosure of the categories/specific pieces of personal information we’ve collected, request deletion, request correction, and not be discriminated against for exercising these rights. We do not sell personal information and do not share it for cross-context behavioral advertising outside the consent-gated Marketing category in Section 4. To exercise these rights, contact us using Section 9.
Other states: Depending on your location, you may have additional rights under state privacy laws (e.g., Colorado, Connecticut, Virginia, Oregon). Contact us per Section 9.

8. Children’s Privacy

The Site is intended for business audiences — prospective clients, trade partners, and job applicants — and is not directed to children under 13. We do not knowingly collect personal information from children under 13.

9. Data Security, Retention, and Contact

We implement reasonable administrative, technical, and physical safeguards to protect information collected through the Site, though no method of internet transmission or storage is 100% secure.
We retain trade partner application, bid invitation, and other Site-submitted information for as long as necessary for the business purposes described in this Policy, including maintaining an active subcontractor/vendor network and complying with legal or contractual recordkeeping obligations. Retention periods vary depending on the type of information and its purpose.
